1. About Us

This website, shinewine.co, is operated by SHINEWINE LLP, a partnership registered in India, trading as "Shinewine". In these Terms, "Shinewine", "we", "us" and "our" refer to SHINEWINE LLP, and "you" refers to anyone who visits the website or purchases from us.

These Terms apply to all visits to our website and all purchases made through it. By browsing the website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Return and Exchange Policy, which form part of this agreement. If you do not agree, please do not use the website.

2. Eligibility

You must be at least 18 years old, or the age of majority in your country of residence if that is higher, to place an order. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.

3. Our Products

Shinewine sells fine jewellery set with laboratory-grown diamonds. Lab-grown diamonds are real diamonds with the same physical, chemical and optical properties as mined diamonds, but they are created in a laboratory rather than mined. They are not natural diamonds, and we never represent them as such.

Where a product page states that a diamond is certified, the piece is supplied with a grading certificate from an independent laboratory such as IGI, GIA, SGL or IDT. Certificates reflect that laboratory's independent assessment. Grading standards can differ slightly between laboratories, and we are not responsible for such differences. Certificate numbers can be verified directly on the issuing laboratory's website.

Our gold jewellery is made in 14kt gold, available in white, yellow and rose, and is BIS hallmarked.

Each piece is handcrafted, so minor variations in metal weight, dimensions and finish from the stated specifications are normal and are not defects. Diamond weights and measurements are stated as per the certificate or within standard industry tolerances.

Product images, including digital renders, are for illustration. We make every effort to show our jewellery accurately, but colour, sparkle and scale can appear different depending on lighting and on your screen. The piece you receive will be made to the specifications described on the product page.

4. Made-to-Order Production

Most of our jewellery is crafted to order after you place your order. Production typically takes around 10 days, plus shipping time. Estimated timelines shown on the website are not guaranteed, but we will contact you if we expect a significant delay. Custom, engraved or specially sized pieces may take longer and may be subject to the restrictions set out in our Return and Exchange Policy.

5. Prices and Currency

Prices on our website are listed in US Dollars (USD). If you pay in another currency, the exchange rate and any conversion fees are set by your bank or payment provider, not by us.

Prices for gold and diamond jewellery can change with market conditions, and we may update prices at any time without notice. The price that applies to your order is the price shown at the time you place it. If a product is listed at an obviously incorrect price due to a technical or typographical error, we may cancel the order and issue a full refund, even after it has been placed.

6. Orders and Acceptance

Your order is an offer to purchase. The confirmation email you receive after checkout acknowledges that we have received your order, but it does not mean your order has been accepted. Your order is accepted when we confirm it and begin production or dispatch.

We may decline or cancel any order, in full or in part, if the product is unavailable, if we cannot verify payment or identity, if we suspect fraud, if there is a pricing or listing error, or if fulfilling the order would breach any law. For high-value orders, we may ask for additional verification before processing. If we cancel an order after payment, we will refund the full amount to your original payment method.

7. Payment

We accept payment through the following providers:

• Customers in India: PayU (credit and debit cards, UPI and net banking).
• International customers: PayPal.

We do not offer Cash on Delivery. All payments are processed securely by these providers, and we do not store your card details. Full payment is required before production begins.

8. Shipping, Customs and Delivery

Delivery timelines, shipping charges and destinations are set out in our Shipping Policy.

For international orders, you are the importer of record. Import duties, customs charges and local taxes in your country are not included in our prices and must be paid by you on delivery. If you refuse to pay these charges and the shipment is returned to us, we may deduct return shipping costs and any charges we incur from your refund.

Ownership and risk of loss pass to you when the order is delivered to your shipping address.

9. Returns, Exchanges and Cancellations

Returns, exchanges and cancellations are governed by our Return and Exchange Policy. Because many of our pieces are made to order, custom, engraved or resized items may have different return terms, as described in that policy.

10. Manufacturing-Defect Warranty

We warrant that every Shinewine piece is free from defects in materials and workmanship. If a covered manufacturing defect appears, we will repair or replace the item, at our discretion, free of charge.

This warranty does not cover:

• normal wear and tear, including scratches, dents or thinning of metal over time;
• damage caused by accidents, impact, misuse or improper care;
• loss of stones caused by knocks, impact or damage to the setting from wear;
• items that have been repaired, resized or altered by anyone other than Shinewine;
• loss or theft.

To make a warranty claim, email care@shinewine.co with your order number, a description of the issue and clear photos. We will review your claim and let you know how to send the item to us.

11. Trade and Wholesale Enquiries

We welcome enquiries from retailers, wholesalers and other trade buyers. Trade orders may be subject to separate pricing, minimum quantities and terms agreed in writing. Please contact care@shinewine.co for trade enquiries.

12. Purchases on Other Platforms

Shinewine also sells through third-party marketplaces such as Etsy, eBay and Catawiki. Purchases made on those platforms are also subject to that platform's own terms and buyer policies. Where the platform's terms differ from these Terms for a purchase made on that platform, the platform's terms apply to that purchase.

13. Use of the Website

You agree not to use our website or its content:

• to submit false information or impersonate any person;
• to upload viruses or malicious code;
• to scrape, copy or collect data from the website by automated means;
• to interfere with the website's security or operation;
• to harass, abuse or harm others.

You confirm that your content is your own, is accurate, and does not infringe anyone's rights or contain unlawful, offensive or misleading material. We may remove any content at our discretion.

16. Third-Party Links and Services

Our website may contain links to third-party websites or use third-party services such as payment providers and shipping carriers. We do not control these third parties and are not responsible for their content, policies or practices. Your use of their services is subject to their own terms.

17. Privacy

Your use of the website and any personal information you provide are governed by our Privacy Policy.

18. Limitation of Liability

To the maximum extent permitted by law, Shinewine will not be liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue or data, arising from your use of the website or any product. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded or limited by law, including your rights under India's Consumer Protection Act, 2019, or under the mandatory consumer laws of your country of residence.

19. Indemnity

You agree to indemnify Shinewine against any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party rights.

20. Events Beyond Our Control

We are not responsible for delays or failure to perform caused by events beyond our reasonable control. These include natural disasters, pandemics, strikes, government action, customs delays, carrier disruptions and failures of the internet or payment systems.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from them are subject to the exclusive jurisdiction of the courts at Surat, Gujarat, without affecting any mandatory rights you have under the consumer laws of your country of residence.

22. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Terms in effect when you placed your order apply to that order.

23. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right does not waive that right. These Terms, together with the policies referred to above, form the entire agreement between you and Shinewine regarding your use of the website and purchases made on it.
